1. Agreement to Terms

By accessing and using the Wildcat Fire Inc. ("WFI", "we", "us", or "our") platform and services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Services Description

Wildcat Fire Inc. provides a comprehensive recruiting and training management platform designed specifically for wildland firefighting and support services. Our platform facilitates:

• Candidate recruitment and tracking
• Training and certification management
• Job placement services
• Communication and notification systems

3. User Accounts

To access certain features of our platform, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

4. User Conduct

You agree not to:

• Use the platform for any unlawful purpose
• Impersonate any person or entity
• Interfere with or disrupt the platform's operation
• Attempt to gain unauthorized access to any portion of the platform
• Upload or transmit any malicious code, viruses, or harmful data
• Violate any applicable local, state, national, or international law

5. Training and Certification

WFI provides training tracking and certification management services. While we strive to ensure accuracy:

• You are responsible for maintaining current and accurate training records
• WFI is not responsible for the validity or recognition of certifications by third parties
• You must comply with all training requirements set forth by applicable agencies and employers

6. Privacy

Your use of our platform is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

6A. SMS Terms and Conditions

If you voluntarily opt in to receive SMS (text message) communications from Wildcat Fire Inc. ("WFI"), you agree to receive service-related messages regarding your application status, recruiter communications, training registration reminders, class logistics, eligibility status, and employment-related updates.

• Message frequency varies based on your application and training activity.
• Message and data rates may apply according to your mobile carrier plan.
• Opt-Out: You may opt out at any time by replying STOP to any SMS message.
• Help: Reply HELP for assistance or contact us using the information in Section 14.
• Optional Participation: SMS communications are optional and are not required to apply, enroll in training, or be considered for employment.

WFI does not send marketing or promotional text messages unless separately authorized. Participation in SMS communications is limited to operational, application, training, and employment-related notifications.

Mobile carriers are not liable for delayed or undelivered messages.

7. Intellectual Property

All content, features, and functionality of the platform, including but not limited to text, graphics, logos, and software, are the exclusive property of Wildcat Fire Inc. and are protected by copyright, trademark, and other intellectual property laws.

8. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WFI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WFI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Indemnification

You agree to indemnify, defend, and hold harmless Wildcat Fire Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or relating to your use of the platform or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your account and access to the platform at any time, with or without cause or notice, for any reason, including violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the platform after such modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to conflict of law principles.
